Asha Devi: ’Rape has become a part of our culture'

Asha Devi’s voice is heavy with helplessness over the phone. On the fourth anniversary this week of the horrific Nirbhaya incident in 2012, she will be sitting at the Jantar Mantar again. Jyoti Singh’s (Nirbhaya) mother says this is all she can do because nothing has changed

“I cannot understand anymore what I can do. Rape has become a part of our culture and our society has accepted it. 
A news report about a woman getting raped does not shock anyone anymore
But the family who has to lose their child, can never forget the injustice done to them,” said Asha Devi.
“There won’t be any large scale rallies or mass mobilisation efforts. I am going to go to Jantar Mantar and be there. We have tried so hard to bring about positive changes in the law. The law and order situation is something that I cannot change just because I want to. But I can expect my society to try to change itself. People who rape women are also products of our society. They are among us and they are part of us. If we change our attitudes, it will definitely affect the sick mindset of such people who think that they can play with a woman’s dignity,” Asha Devi said.

Asha Devi’s 23-year-old daughter Jyoti Singh was a physiotherapy intern in Delhi who was beaten, gang raped, and tortured in a private moving bus on 16 December 2012.
She was returning after watching a movie with her friend, Awindra Pratap Pandey, on the night of the fatal assault in Munirka in South Delhi. The six other men in the bus who were posing as passengers were the driver’s friends who physically assaulted Awindra Pratap and gang-raped Jyoti. Jyoti died 13 days later, succumbing to her injuries in a Singapore hospital. There had been widespread protests across the country as public anger took over.

However, since 2012, neither have rape incidents witnessed any decrease in numbers nor has the law and order situation changed, in general.
During an informal discussion with this reporter, a senior official of Delhi police said, “For the police in Delhi, the crime which is the biggest nuisance is rape. Earlier, Delhi used to have gangs, notorious burglars, car thieves, etc. There used to be smugglers who were a big challenge and then there were some sharp shooters. Police had to fight these people. But now there are no organised gangs as such. There is no mastermind rackets that have made Delhi police lose its sleep. There is crime and still there are criminals. But, comparatively, things are largely under control, except rape. It has been a real challenge for the police to be able to come up with an effective blue-print to fight rape.”
There a number of initiatives that Delhi Police has launched like introducing an all women PCR van, conducting self-defence classes for the public, women’s help-line number etc., but none of these have resulted in a decrease in the number of rape cases being reported in the country.
Delhi police has maintained that the rising number of FIRs in rape cases is due to increasing awareness among people that encourages them to report the crime.
However, Asha Devi said, “Yes, more women report sexual offences now because of awareness among the public. Women want to report such crimes now though there still remains a taboo attached. But the crime has been increasing as well. Even after our daughter’s case, there have been major gang-rape incidents in the country that made it to national news. How can we claim that rape has not increased?”

December 16 is the fourth anniversary of the heinous gang-rape of a 23-year-old paramedic in Delhi that shook the entire country’s conscience. In a bid to express anguish and solidarity with the victims of sexual assault, the parents of `Nirbhaya` called for a meeting here. 

Unable to get over their pain, Nirbhaya’s parents discussed how much has changed or stayed the same since the incident which took place in 2012. 

Four years have passed but the violators of my daughter have still not seen the flame of justice. I want to see them hanged as soon as possible. They deserve such punishment, nothing less,” Nirbhaya`s mother said. 

That the anger of the people who had taken to the streets post December 16, in solidarity with the victim, is not yet extinguished was evident from the reaction from one of the agitators present at the gathering. 

We want hanging of those beasts. Until that happens we won`t stay quiet or be placated. The crime that they committed is nothing less than barbarity, and they have no place in the civil society,” a close friend of the victim`s family, Akashdeep, told IANS. 

The rape which had occurred on December 16, 2012, had seen massive protests across India, especially in the national capital, where countless youth had spilled out on the streets and at prominent places, asking for the heads of the culprits. 

The brutal rape by six persons, including a juvenile, was committed inside a moving bus when the victim along with her male friend was returning home from watching a movie and had boarded the bus at Munirka bus stop. 

The case was sensational for the grade of brutality which was committed during it, with disgorged bowels and a battered body completing the details. The doctors were reported as shocked when they first saw the state of the victim and so was everyone who heard of it on TV or elsewhere. 

The incident, which engulfed the media space like a wildfire for months, also resulted in a committee for a reappraisal of the laws on rape, known as Justice JS Committee, which submitted its recommendations on January 23, 2013. 

The committee went through the laws related to immoral trafficking, crimes against women at workplaces, child sex abuse, among other crimes, and bore its weight against the mob sentiment prevailing then, when it ruled out the death penalty and chemical castration as one of the punishments for rape, and recommended life -imprisonment instead. 

The six accused were awarded death sentence in September 2013, the sentence being upheld by the Delhi High Court as well in 2014. 

While others waited for their fate, Ram Singh, one of the six accused, hanged himself in his cell inside the Tihar Jail in March 2013. The remaining five still await the Supreme Court decision, where they have appealed for commutation to life sentence. 

A fund of Rs 200 crore known as `Nirbhaya Fund` has also been allocated since by the central government, to help rehabilitate victims of sexual abuse.



On the fourth anniversary of the Nirbhaya incident, the Delhi government organised a solo act by renowned theatre actor Shilpi Marwah which received a big round of applause. A solo act titled A Women Alone and a street play Dastak was performed by Asmita theatre group. Directed by Arvind Gaur and performed by Shilpi Marwah, the solo act was a success.
Thousands of people under the open programme Nirbhaya Sada: The Fight Continues witnessed back-to-back satirical plays that questioned a woman's status in society.

Student collective Pinjra Tod chose the anniversary of the December 16 outrage on Friday to exhort people to "resist and speak up against the daily structural violence that continues to take place against women".

GURGAON: A peaceful protest near the bus stand at Mahavir Chowk on Friday afternoon against police inaction in the rape-murder of a four-year-old girl last month took a violent turn as the police tried to disperse the crowd to clear the logjam on the road.

Nine of the 350-400 protesters were arrested for allegedly attacking police personnel. The agitators, however, said that it was the police who initiated violence. The protest was purposely organised on December 16, four years since the gruesome Nirbhaya incident shook the entire nation.

Delhi Commission for Women chairperson Swati Maliwal said rape has turned into “an epidemic”. Maliwal blamed the Centre for failing to hold high-level meetings on women’s safety that the commission had been urging it to hold for months. “Nothing has changed in Delhi in the last four years. We have been asking the Centre to set up a high-level committee, including Rajnath Singhji, Arvind Kejriwalji, the L-G and the Police Commissioner, and it should meet at least twice a month,” Maliwal said.

On December 16th 2012, Jyoti Singh, a physical therapy intern, was gang-raped on a bus in New Delhi and later died from injuries suffered during the attack. To mark the anniversary, Singh’s mother, Asha Devi, has said she intends to sit at the Jantar Mantar monument in protest. Writing for Feministing, Reina Gattuso paid tribute in her own way — by highlighting the advances and setbacks that have come in the wake of the brutal attack.
Responding to nationwide protests after Singh’s murder, an Indian government committee issued the Justice Verma Committee Report, which identifiedfailure of governance” as the principal cause of sexual crimes in the country. The report offered practical recommendations such as the criminalization of marital rape and the elimination of military impunity in cases of sexual violence — neither suggestion has yet been made into law.
In the meantime, Gattuso wrote, anti-Muslim politicians twisted the conversation from “women’s safety” to “love jihad” — the notion that Muslim men kidnap Hindu girls. Meanwhile in Delhi, Gattuso noted, the movement Pinjra Tod, or “break the cages,” has been working to change policies at universities so that women are no longer locked up in their accommodations after 8pm “for their own good.”
With sexual violence prevalent on college campuses and victims being blamed or even taken advantage of by police, America too must look in the mirror, added Gattuso. Especially since the country’s “soon-to-be president,” she noted, is himselfa known sexual assailant.”
A documentary, India’s Daughterfocusing on the tragic attack and its aftermath was subsequently banned by Indian Prime Minister Narendra Modi, leading to further controversy. The number of reported rapes in 2015 was 34,651, up 39% since the year before the famous gang rape. Activists say the growth could actually be a sign of progress as it may mean more women have become emboldened enough to report the crime.

Out of every 100,000 females in Delhi, there were 184 cases of sexual assault, physically abuse or dowry demands filed in 2015, police said.

India arrested 19,973 persons in 2015 for murdering or harassing women into suicide over dowry demands

India arrested 101,571 people in 2015 for abusing a woman physically or requesting sexual favors. That is nearly 79% more than 56,827 persons arrested for those crimes in 2012.

The number of persons arrested for rape in India rose 35% to 42,036 in 2015 compared to the 31,117 persons arrested in 2012.

# 88 per cent of accused had studied up to Class 10, 10 per cent were illiterate and less than 2 per cent graduates.
# 45 cases of illicit liquor consumption, 34 cases of gambling and 12 cases of drug use were registered this year.
# And, the police station has 155 personnel against a sanctioned strength of 210, which means one policeman for almost 5,000 people.
People migrate from different parts of the country and settle down in Aman Vihar. They don’t have permanent addresses. Their identity remains a mystery. The area has also seen a rise in land disputes, and there are 108 unauthorised colonies. The same person who commits a petty theft can be involved in rape. Also, job losses results in drug addiction and gambling,” says a police officer, who was professionally involved with the district and is now with the LNJN National Institute of Criminology and Forensic Sciences, Delhi.
“Don’t look at the rise in cases of rape in isolation, but look at the rise in other criminal activities. That will explain a place like Aman Vihar,” he says.
According to local AAP MLA, Rituraj Jha, 95 per cent of the population are migrants and the literacy rate is abysmal. “It’s just about 50 per cent (the city’s is over 86 per cent). Most of the young men are unemployed so they indulge in petty crime like betting and consuming liquor in public places,” says Jha.
Advocate Shubra Mendirata, member, Delhi Commission of Woman, says that a majority of the cases of sexual assault registered in Aman Vihar this year involved minors in unauthorised colonies.
“What is more shocking is that most of the accused persons are strangers. Children are usually subjected to sexual assault when their parents, mostly daily-wage labourers, are out for work,” she says.
Vivek Aggarwal, Assistant District Magistrate (North-West), says one of the reasons for the spike in sexual assault here is what he calls the floating population which gets power from its anonymity. “People stay here for a very short period, due to which it is very difficult to establish their identities. This area is in a developing stage, hence most criminals find easy escape routes,” says Aggarwal. A walk around Aman Vihar underscores this assessment. The lanes are narrow and houses — 24-30 sq ft — are packed wall to wall with up to six occupants in each.
In some parts, there are no sewage lines, which means no toilets. “We don’t have any public toilet or sewer line, what can we do? Our family members, including women, have to relieve themselves in the open every morning,” says Manoj Kumar, a resident in Prem Nagar, who migrated to Aman Vihar 17 years ago. Residents say this makes the women in the area particularly vulnerable.
In a desperate effort to tackle the crime rate, the district administration is now preparing to install CCTV cameras and more streetlights. But it’s a long road — of the 98,344 street light points for a population of 3.6 million in northwest Delhi. With a third of that population, Aman Vihar has only 770 — less than one percent.

Four years after Nirbhaya, many big issues remain unresolved. One of them is the absence of a standardised procedure in the collection of forensic evidence in cases of sexual assault.




A full probe across all the state ranges followed and, as it stands today, at least 165 cases, including murder and rape, are yet to be chargesheeted in the 2015-16 period.

“In at least 123 cases, the accused has gone to the High Court for bail and the Investigating Officer has stopped the probe. Further, in several cases, the High Court had not given a stay but the Investigating Officer misunderstood it to be so and stopped all investigation. Crucial time has been lost,” said Khalid.
